Where can you smoke cannabis in Ohio?
Only on private property, with the owner's permission. Using cannabis in public is illegal everywhere in Ohio — sidewalks, parks, parking lots, bars, restaurants and events included — for adult-use customers and medical patients alike. Here's how the rules work in the places people ask about most.
Where you can use cannabis, in brief.
- Smoking and vaping cannabis are only allowed on privately owned residential or agricultural property.
- Using cannabis in any public place is illegal.
- Property owners and landlords can say no — tenants and guests have no automatic right to use cannabis.
- No cannabis lounges or consumption sites are allowed anywhere in Ohio.
- A medical card doesn't allow public use.

The short answer: private property only
Ohio law says no one may use cannabis in a public place, and no one may smoke, combust or vape it anywhere other than privately owned property used mainly as a home or farm (Ohio Revised Code 3796.06). Breaking the rule is a minor misdemeanor — a fine of up to $150, no jail time, but still a citation on your record.

Using cannabis on private property
- You own your home: you can use cannabis inside and on your property, including your porch and backyard, unless HOA rules say otherwise.
- You're a guest: you need the owner's permission.
- Childcare homes: smoking and vaping cannabis aren't allowed at any time in a home that also runs as a childcare center.
- Halfway houses and similar facilities: smoking and vaping cannabis aren't allowed.
Renters, condos and hotels
Landlords can ban smoking and vaping cannabis in the lease, and Senate Bill 56 made that explicit for vaping too. Breaking a no-cannabis lease term can be grounds for eviction. Condo and HOA rules can also restrict use. Hotels are almost always smoke-free. If you're visiting Ohio, look for a short-term rental that explicitly allows cannabis before you book.
Public places
Using cannabis in public is illegal in Ohio, in any form. That includes:
- Streets, sidewalks and parking lots,
- Parks, campuses and public venues,
- Bars, restaurants and events, and
- Any indoor public place covered by Ohio's smoke-free law, which applies to vaping too.
Workplaces
Ohio employers can ban cannabis use, drug test for THC, discipline or fire employees and refuse to hire someone for a positive test — including for off-duty use. Federal rules still apply to commercial drivers, federal contractors and other federally regulated jobs, whatever Ohio law allows.
Can you use cannabis in a car?
No. Drivers can't use cannabis in a vehicle, and a passenger who smokes or vapes while the vehicle is being driven commits a third-degree misdemeanor. When carrying cannabis, keep opened containers in the trunk or behind the last upright seat. See Ohio's cannabis DUI laws.
Are there cannabis lounges in Ohio?
No. Ohio doesn't allow cannabis lounges, social-use venues or on-site consumption anywhere — including dispensaries, cafés and events. If you buy at a Bloom dispensary, the only legal place to use it is private property where the owner allows it.
Medical patients
The same rules apply to registered medical patients. A medical card doesn't allow use in public places or workplaces. Medical cannabis also can't be smoked or combusted at all, and registered caregivers administering cannabis to a patient still need to do it in a private setting. Ohio employers don't have to accommodate medical cannabis use.
Plan where you'll use it before you buy
- Ohio residents: if you rent or live in a condo, check your lease or HOA rules before your first purchase.
- Visitors: book a cannabis-friendly rental before your trip.
- Travelling home: cannabis can't cross state lines, even between two states where it's legal. Don't buy in Ohio planning to take it home.
