Is it legal to grow cannabis in Ohio?
Yes. Home cultivation became legal when Ohio voters passed Issue 2 in November 2023, and it took effect that December. The rules are now in Ohio Revised Code 3796.04. Senate Bill 56, in effect since March 20, 2026, kept the plant limits the same.

A note from us: Bloom doesn't sell seeds, clones or growing supplies — we sell finished cannabis at our Ohio dispensaries. But customers ask about home grow all the time, so here's the full picture.
How many cannabis plants can you grow in Ohio?
- Up to 6 plants per adult 21 or older, and
- Up to 12 plants per household when two or more adults 21 and older live there.
The 12-plant household cap is a ceiling: three or four adults in one home are still limited to 12 plants in total.
Where and how you can grow
- Grow at your residence, in a secured, enclosed area.
- The area must be inaccessible to anyone under 21.
- Plants can't be visible from a public space with normal, unaided vision.
- Since Senate Bill 56, home grow isn't allowed at childcare centers, halfway houses and similar facilities.
What you can do with what you grow
- Use it at home, within Ohio's rules on where you can use cannabis.
- Process it by manual or mechanical means. Hydrocarbon-based extraction (such as butane) is prohibited.
- Share it with another adult 21 or older — up to 2.5 ounces and 15 grams of extract — with no money changing hands, at a private home or farm.
- Never sell it. You also can't grow on behalf of someone else.
What happens if you grow more than allowed?
Growing outside the rules — too many plants, in the wrong place, or for someone else — can be charged as illegal cultivation under Ohio's drug laws. Selling homegrown cannabis can bring trafficking charges, which are more serious. If you're unsure, stay well under the limit.
Renters, landlords, HOAs and federal housing
- Your lease comes first. Landlords can prohibit cultivation, and many leases already ban activity that's illegal under federal law.
- HOA rules are enforceable, even where Ohio law allows home grow.
- Federally assisted housing — Section 8, HUD-funded and public housing — follows federal law, and cannabis activity can lead to eviction.
Federal law and employment
- Cannabis is still illegal under federal law.
- Ohio employers can test for cannabis and discipline or fire employees under their own policies, including for off-duty use.
- Federal employees, security clearance holders and federally regulated workers such as commercial drivers face federal rules regardless of Ohio law.
- Never cross state lines with homegrown cannabis, even into another legal state.
Medical patients and home grow
The same limits apply to medical patients who are 21 or older — a medical card doesn't allow more plants. Patients under 21 can't grow at home and buy through licensed dispensaries instead. Patients 18 and older register on their own; patients under 18 need a parent or legal guardian as their caregiver. For many patients, buying is simpler: no 10% excise tax, the option to buy up to four days' supply in one visit, and no equipment or electricity costs. See the Ohio medical marijuana card guide.
Growing vs. buying at a dispensary
- Growing takes months, space, equipment and electricity, and homegrown cannabis isn't lab-tested.
- Buying gets you lab-tested, labeled products right away, with a choice of strains and formats you couldn't grow yourself.

Do I need a license to grow cannabis at home in Ohio?
No. Adults 21 and older can grow at home without a license, permit or registration, as long as they follow Ohio's plant limits and security rules.
Can I grow cannabis outdoors in Ohio?
Only in a secured, enclosed area that people under 21 can't get into and that can't be seen from a public space. An open backyard doesn't qualify; a locked, enclosed structure can.
Do seedlings and clones count toward the limit?
Ohio's law caps the number of plants without separating them by stage, so the safest reading is that every growing plant counts — seedlings and clones included.
Can two adults living together grow 6 plants each?
Yes, up to a combined household maximum of 12. However many adults live in the home, the household cap is 12 plants.
Can I sell or give away cannabis I grow?
You can't sell it. You can give homegrown cannabis to another adult 21 or older — up to 2.5 ounces and 15 grams of extract — as long as no money changes hands and the transfer happens at a private home or farm.
Did Senate Bill 56 change Ohio's home grow rules?
Senate Bill 56 kept the 6-per-adult and 12-per-household limits. It added a ban on home grow at childcare centers, halfway houses and similar facilities, and narrowed lawful cannabis to what's bought in Ohio or grown legally in Ohio.
