Delta 8 THC in Ohio: what's legal, what's banned, and where to buy.
Since March 20, 2026, hemp-derived delta 8 and other intoxicating hemp products can't be sold in Ohio outside a state-licensed cannabis dispensary. Here's what changed, what's still available, and where to shop legally.
In this guide
Is delta 8 THC legal in Ohio?
Not outside a licensed dispensary. Senate Bill 56 took effect on Friday, March 20, 2026, and set a limit of 0.4 mg of total THC per container for hemp products. Anything above that is marijuana under Ohio law, and only a dispensary licensed by the Ohio Division of Cannabis Control can sell it. Most delta 8 gummies, vapes and tinctures held far more than 0.4 mg per package, so they're off the shelves everywhere else.
You don't need a medical card to buy regulated THC products. Any adult 21 or older with a valid ID can shop at a licensed dispensary, and registered patients can see our Ohio medical marijuana card guide.

What Senate Bill 56 banned
The law targets a whole category, not one cannabinoid. Outside licensed dispensaries, Ohio now bans:
- Delta 8 THC products — gummies, vapes, tinctures and flower sprayed with delta 8,
- Hemp-derived delta 9 THC products, including THC seltzers, drinks and edibles,
- Delta 10, HHC, THC-O, THC-P and other novel hemp cannabinoids,
- THCA flower marketed as legal hemp, and
- Any hemp gummy, drink or vape above 0.4 mg of total THC per container.
Why Ohio banned intoxicating hemp
The Ohio Department of Commerce says many of these products were untested, sold outside the regulated cannabis market and packaged to look like candy, cereal and gummies that appeal to children. Products sold at licensed dispensaries are grown, processed and tested in facilities approved by the Division of Cannabis Control, and sold in child-resistant packaging.
