Maryland cannabis possession limits, explained.

Adults 21 and older can legally possess cannabis in Maryland within a set personal use amount. Go above it and you face a civil fine; go further and possession becomes a crime. Here's exactly where the lines are.

Quick summary

Maryland possession limits at a glance.

Personal use amount (legal)

1.5 oz

Adults 21 and over may possess 1.5 ounces of flower, 12 grams of concentrate, or cannabis products containing up to 750 mg of THC.

Civil use amount

Up to 2.5 oz

Above the personal use amount, up to 2.5 ounces of flower, 20 grams of concentrate or 1,250 mg of THC, is a civil offense with a fine of up to $250.

Over the civil use amount

Criminal

More than that is a misdemeanor that can carry up to six months in jail and a $1,000 fine.

What are the legal possession limits in Maryland?

Maryland law sets a personal use amount for adults 21 and older. You may possess up to:

  • 1.5 ounces of cannabis flower, including pre-rolls,
  • 12 grams of concentrated cannabis, such as vapes, wax, shatter or resin, or
  • cannabis products containing up to 750 mg of THC, such as gummies, chocolates, drinks, capsules and tinctures.

There's no limit on lotions and other topicals. These amounts come from Maryland's Criminal Law Article (§ 5-101), set by the Cannabis Reform Act of 2023, and only the General Assembly can change them.

Buying vs. possessing

At a licensed dispensary, a recreational customer can buy up to the personal use amount in a single transaction: 1.5 ounces of flower, 12 grams of concentrate, or cannabis products containing up to 750 mg of THC. For edibles and other infused products, it's the THC on the label that counts, so check the milligrams before you order.

Limits for medical patients

Registered patients don't buy against the recreational limit. Their provider's certification sets a 30-day supply: the standard is 120 grams of flower or 36 grams of THC in other products, and a provider can certify a patient for more or less. The Maryland Cannabis Administration tracks it on a rolling 30-day cycle, not by calendar month, so what you can buy today is your certified amount minus everything you bought in the last 30 days. Patient purchases are also exempt from Maryland's 12% cannabis sales tax. See how to get a Maryland medical card or renew your card.

What happens if you go over the limit?

  • Civil use amount — more than the personal use amount but no more than 2.5 ounces of flower, 20 grams of concentrate or 1,250 mg of THC: a civil offense with a fine of up to $250. It isn't a criminal conviction.
  • More than the civil use amount: a misdemeanor that can carry up to six months in jail and a $1,000 fine.
  • Intent to distribute or selling without a license: a separate and more serious crime, whatever the amount.

Using cannabis in public is a separate civil offense, even if you're under the possession limit. More on where you can use it is in our guide to Maryland cannabis laws.

Can you carry cannabis in a car in Maryland?

Yes, within the possession limit. What Maryland law prohibits is using it: a driver can't smoke or consume cannabis in the passenger area, and passengers can't smoke there, whether the car is moving or parked. To stay clear of trouble at a stop:

  • Keep purchases sealed in their original packaging.
  • Store them in the trunk or a locked glove compartment, out of reach of the driver.
  • Never drive impaired. See Maryland's cannabis DUI laws.

Can you grow cannabis at home?

Adults 21 and older can grow two plants per household — the cap is per home, not per person, and seedlings count toward it. Registered medical patients 21 and older can grow up to four plants, and that four-plant cap also applies per home however many patients live there. Plants must be at your residence, out of public view, and kept somewhere secure that people under 21 can't get to. Renters should check their lease, since landlords can prohibit growing. Growing more than allowed is illegal.

Can you share cannabis with another adult?

Yes, as a true gift. An adult 21 or older can give another adult 21 or older up to the personal use amount, as long as no money or anything else of value changes hands. Anything that works like a sale is treated as one, and selling cannabis without a license is a crime.

Federal law and travel

Cannabis is legal under Maryland law but still illegal under federal law. That matters most when you:

  • Leave Maryland with cannabis — it can't cross a state line, even into DC, Virginia, Delaware, Pennsylvania or West Virginia,
  • Are on federal property, such as BWI Marshall Airport, military installations, national parks and federal buildings, or
  • Work in a federally regulated job or live in federally assisted housing.

Questions

Common questions about Maryland possession limits.

How much cannabis can I legally carry in Maryland?

Adults 21 and older can carry Maryland's personal use amount: 1.5 ounces of flower, 12 grams of concentrate, or cannabis products containing up to 750 mg of THC. Above that, up to 2.5 ounces of flower, 20 grams of concentrate or 1,250 mg of THC, is a civil offense with a fine of up to $250.

How much can I buy at a Maryland dispensary?

Up to the personal use amount in a single transaction: 1.5 ounces of flower, 12 grams of concentrate, or cannabis products containing up to 750 mg of THC. Registered medical patients buy against the 30-day supply in their certification instead.

Can you go to jail for cannabis possession in Maryland?

Possessing more than the civil use amount is a misdemeanor that can carry up to six months in jail and a $1,000 fine. Possession with intent to distribute, and selling without a license, are separate and more serious crimes. Amounts up to the civil use amount do not carry jail time.

Can out-of-state visitors possess cannabis in Maryland?

What happens if someone under 21 is caught with cannabis?

Possession by a person under 21 is a civil offense, not a crime, for amounts up to the civil use amount. It can bring a fine, a court order to attend drug education, and a referral for a substance use assessment.
